Data Privacy Policy

for the website https://software.frankingermann.de

First of all: this is a private, non-commercial site that i operate for my Joomla! plugin "GPXTrackMap". It serves to download the plugin, provide documentation and operating instructions about it, and provide a support forum where users of the plugin can find help and support for it.

I have no commercial interests (the plugin is Open Source) and i generally have no interest in your personal data. However, to offer you this support, i obviously need to process some of your personal data to be able to communicate with you. I operate this site purely on a private, hobby basis.

In general, this website may be used without entering any personal information. Different rules may apply to certain services on the site, however, and are explained separately below. If you use the contact form or regsiter in the support forum, i collect personal information from you (e.g. name and email address) in accordance with the provisions of German data protection statutes. Information is considered personal if it can be associated exclusively to a specific natural person. The legal framework for data protection may be found in the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG-neu (2018)) and the German Telemedia Act (TMG). The provisions below serve to provide information as to the manner, extent and purpose of collecting, using and processing personal information by me.

The controller for the processing of personal data on this site is:

Frank Ingermann
In den Stecken 11

Data Protection Officer

I have not assigned a Data Protection Officer because i don't need to.

SSL encryption

To protect data you may enter on this site, this site uses SSL encryption to transfer data between your browser and the web server. This way, data you enter here can not be read by others during transport between your device and the webserver.

Please be aware, however, that data transfer via the internet is subject to security risks and, therefore, complete protection against third-party access to transferred data cannot be ensured.

What personal data is stored here?

Data stored in cookies

Unless you decline their use, this website makes use of so-called cookies in order to recognize repeated use of the website by the same user/internet connection subscriber.

Cookies are small text files that your internet browser downloads and stores on your computer or device. They are used to enable or improve some of the website's functions. In most cases these are so-called "session cookies" that are deleted once you leave this website. None of the data in the cookies that i have control over store any personal data. Cookies stored by third-party services, however, may contain personal data that i have no control over (see Google Maps and reCaptcha below).

Details on the cookies used by the website itself can be found in the Cookie Policy.

You can prevent cookies from being installed by adjusting the settings on your browser software accordingly. You should be aware, however, that by doing so you may not be able to make full use of all the functions of the website.

Data stored in Server Log Files

I do not run a web server myself, i make use of an internet service provider (ISP) who runs the web server. Since the ISP processes data (including personal data) to provide this service, the ISP is a "Processor" in the sense of the GDPR who processes this data on my behalf. Therefore i have signed a Processing Contract with the ISP. The ISP operates the web servers solely in Germany.

The ISP's web server collects data such as the following, which your internet browser transmits to the web server, in so called server log files:

- type and version of the browser you use

- operating system of your device

- websites that linked you to my site (referrer URL)

- date and time of your visit

- your Internet Protocol (IP) address.

This data is stored separately from any personal information you may have provided. The ISP collects this data to be able to analyse problems with the web server and to detect possible attacks to the web server, e.g. by hackers. The data is stored for seven days and then gets deleted automatically.

I can not see this data in all detail, i only have access to an excerpt of these data because i have set up my account this way. Especially, i can not see complete IP address in the logs, i can only see anonymized IPs. This way, i can impossibly connect these IPs to any person.

Data stored when you contact me

On this website i offer you the opportunity to contact me, either by email and/or by using a contact form. In such event, information provided by you is stored for the sole purpose of communicating with you. No data is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of the website.

Registration in the support forum

I offer you the opportunity to sign up for the support forum on this website. The information entered when signing up, as shown in the registration form:

Your Name, your email adress, the message you enter and the consent to storing and processing the data you have entered according to the GDPR

is collected and stored solely for use by this website. When signing up for the forum, i also store your IP address and the date and time you registered. This serves to protect me in the event a third party improperly and without your knowledge makes use of your data to sign up for our site, or a user posts content to the forum that conflicts with regulations such as copyright laws. None of this information is transferred to third parties unless i am forced by law to do so. Nor is any of this information matched to any information that may be collected by other components of the website.

Posting Comments in the Forum

On this website i offer you the opportunity to post comments or questions regarding the plugin in the support forum. For this purpose, the IP address of the user/internet connection subscriber is stored. This information is stored for my security in the event the author through his/her comments infringes against third party rights and/or unlawful content is entered. Consequently, i have a direct interest in the author’s stored data, particularly since i may be potentially liable for such violations. No data is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of the website.

Subscribing to Comments in the Forum

In the support forum, i offer you the opportunity to subscribe to subsequent comments about a post which you wrote or intend to comment on. When you choose this option, you will receive an email when new posts are added to the thread(s) that you have subscribed to. You may at any time revoke your decision to subscribe to such follow-on comments. No data hereby obtained is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of our website.

Data collected by third-party services

Use of Google Maps

Certain pages on this site that showcase the plugin's support for Google Maps use the “Google Maps” API of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, (in short: Google), to display maps via the Google Maps service.

Google sets cookies in order to process the user configuration and data when the page with the integrated “Google Maps” component is displayed. As a general rule, these cookie are not deleted by closing the browser, but rather expire after a certain time, as long as it is not manually deleted by you.

If you do not agree with this processing of your data, you may choose to deactivate the “Google Maps” service and thereby prevent the transfer of data to Google. To do this, you must deactivate the Java Script function in your browser. However, i would like to point out that in this case you will not be able to use “Google Maps” or at least only to a limited extent.

The use of “Google Maps” and the information obtained through “Google Maps” is according to Google’s Terms of Use: https://policies.1d5920f4b44b27a802bd77c4f0536f5a-gdprlock/terms?hl=en

as well as the additional Terms and Conditions for "Google Maps": https://www.1d5920f4b44b27a802bd77c4f0536f5a-gdprlock/intl/en_en/help/terms_maps.html

Use of reCAPTCHA

In order to protect input forms on this site, i use the “reCAPTCHA” service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter "Google." By means of this service it can be distinguished whether the corresponding input is of human origin or is created improperly by automated machine processing.

To my knowledge, the referrer URL, the IP address, the behaviour of the website visitors, information about the operating system, browser and length of stay, cookies, display instructions and scripts, user input behaviour and mouse movements in the “reCAPTCHA” checkbox are conveyed to “Google.”

The IP address provided as part of “reCAPTCHA” is not merged with other data from Google unless you are logged into your Google Account at the time the "reCAPTCHA" plug-in is used. If you want to prevent this transmission and storage of data by Google about you and your behaviour on our website, you must log out of Google before you use the reCAPTCHA plug-in on the contact form of this site.

The use of the “reCAPTCHA” service is according to the Google Terms of Use: https://www.1d5920f4b44b27a802bd77c4f0536f5a-gdprlock/intl/de/policies/privacy/.

With regard to correction of your data as a registered user in the support forum, you can go to your profile (under "preferences") when you are logged in to the forum and correct all data yourself.

Right to data portability

You have the right to receive your data that is stored here in a structured, commonly used and machine-readable format. Right to complain

If you think that i make improper or illegal use of your personal data, you have the right to complain about that with the authorities. You can do this with any authority for data protection. You can contact them via this link: ldi.nrw.de.

Changes to this Privacy Policy

When laws change, terms of services of third party services change, or if i need to correct errors, i may change the content of this privacy policy statement. Since at the time of writing this (May 2018) there is a lot of confusion as to what exactly a GDPR-compliant privacy policy must or may not contain, it is quite likely that i will have to make some changes in the future. You can always find the current version here.
